			<content:encoded><![CDATA[<p><strong>Do End Of Year Gifts To Children and Grandchildren Still Make Sense?</strong><br />

<p>In the last few days of 2010 Congress passed, and the president signed, a new bill governing federal estate and gift taxes.</p>
<p>Since we are so close to the end of a calendar year, many people are calling and asking whether or not to make their traditional end of year gifts.</p>
<p><strong>General Thoughts On Gifting and Gifting Before The End of 2010</strong></p>
<p>In general, you should not make gifts that will negatively impair your personal lifestyle.  This is especially true when you are retired and on a fixed income.</p>
<p>However, many clients find that they are fortunate enough to be building estate value even though they are comfortable in their retirement.  In these cases, or even in cases of smaller estates, where you want to preserve assets and protect them from the nursing home spending, gifts may be a valuable end of year planning strategy.</p>
<p>This article deals predominantly with gifts where you have sufficient funds to avoid medicaid and nursing home issue.  <strong><a href="http://www.utbf.com/trust-estate/2010/12/ the-federal-estate-tax-and-pennsylvania-residents/">If you desire to protect<br />

<p>For those who want to continue making gifts to family members, there is some very good news in the new estate tax law.<br />
<a href="http://www.utbf.com/trust-estate/2010/12/the-federal-estate-tax-and-pennsylvania-residents/"><br />
Here is a quick review of the new federal estate tax law and rates.</a></p>
<p><strong>Strategies For End of Year Gifting and Gifts in 2011:</strong></p>
<p>Since the federal estate tax rate will be the same for the next 2 years, and since five million dollars will be covered and tax free at death (or even during lifetime) for those same two years (before we fall back again to only $1 million dollars) large gifts do not need to be made before the end of 2010 unless very large gifts are being made to grandchildren.</p>
<p>Annual gift tax exclusion gifts (currently $13,000.00) per person can be made before December 31st and again after January first (for 2011) without using any of your lifetime or death exemption. Note that this amount might adjust again in the future.</p>
<p>These annual gifts can be made to children and grandchildren and can be made to the spouses of your children and grandchildren as well. If you are married, both you and your spouse can make these gifts and effectively double the amount that can be given without filing a gift tax return or paying any tax.</p>
<p>In addition, greater amounts can be paid directly to a school or for medical purposes in certain circumstances as well.</p>
<p>In short, make gifts of up to the $13,000.00 per person annual gift tax exclusion amount before the end of the year.  In 2011 gifts in excess of this amount will either be taxed (at the historically low rate of 35% for the next two years)</p>
<p>Since the effectiveness of gifts can vary widely from person to person, and because there are better and worse ways to make gifts depending on your personal circumstances ask your lawyer and/or tax adviser to consider your personal facts and circumstances when advising you on the use of gifts, paying up insurance policies, or the use of trusts, annuities, and other gifting strategies.</p>

lifetime) for those same two years (before we fall back again to only $1 million<br />
dollars) large gifts do not need to be made before the end of 2010 unless very<br />
large gifts are being made to grandchildren.</p>
<p>Annual gift tax exclusion gifts (currently $13,000.00) per person can be made<br />
before December 31st and again after January first (for 2011) without using<br />
any of your lifetime or death exemption. Note that this amount might adjust<br />
again in the future.</p>
<p>These annual gifts can be made to children and grandchildren and can be made<br />
to the spouses of your children and grandchildren as well. If you are married,<br />
both you and your spouse can make these gifts and effectively double the amount<br />
that can be given without filing a gift tax return or paying any tax.</p>
<p>In addition, greater amounts can be paid directly to a school or for medical<br />
purposes in certain circumstances as well.</p>
<p>In short, make gifts of up to the $13,000.00 per person annual gift tax<br />
exclusion amount before the end of the year.  In 2011 gifts in excess of this<br />
amount will either be taxed (at the historically low rate of 35% for the next<br />
two years)</p>
<p>Since the effectiveness of gifts can vary widely from person to person, and<br />
because there are better and worse ways to make gifts depending on your<br />
personal circumstances ask your lawyer and/or tax adviser to consider your<br />
personal facts and circumstances when advising you on the use of gifts,<br />
paying up insurance policies, or the use of trusts, annuities, and other gifting<br />
strategies. </p>

<p>If you inherited assets from a trust or an estate where the decedent died during 2010 you probably thought that you were spared the worries and expenses of the federal estate tax.  And strictly speaking, it appears that you&#8217;d be right. But, you may not have completely dodged the tax bullet and even the IRS hasn&#8217;t weighed in yet on exactly what you need to do.</p>
<p>Congress unexpectedly allowed the federal estate tax to lapse at the end of 2009 and despite regular threats to impose a retroactive estate tax, it appears that there will be no federal estate tax for this year.</p>
<p>However, since most lawyers, accountants and financial advisers expected Congress to address the situation and even the IRS held off, there are now many unanswered questions about the tax returns for these estates and their beneficiaries.</p>
<p>In particular, there are numerous unanswered questions about the new carry over basis rules and what they really mean for estates and beneficiaries who inherit assets and later sell them.</p>

<p><strong>Are Your Pets &#8211; horses, cats or dogs included in your estate plan?</strong> If you have horses, cats, dogs or other pets with long life spans, it might be time to include those pets in your estate planning.  Pets in estate plans are often thought of as an estate planning activity of the rich and famous, but many Americans now purchase pet health insurance, pet vacations, pet day care and many other luxuries for their beloved animals.</p>
<p>So, it&#8217;s only rational to make provisions for your pets in the event of your death.</p>
<p>Estate planning for pets can range from the very simple to the very complex and from very inexpensive to more costly arrangements.</p>
<p>From simple to more complicated here are a few points to consider:</p>
<p>1) <strong>The Informal Memo Option</strong> -At the very least, consider putting together a memorandum to your executor and/or family members suggesting the disposition of your pets.  In this case, where no financial provision is being made for the pets and their care, it is often advisable to discuss the plans with the friends or relatives involved to ensure that they will, in fact, take on the responsibility. In any case, a memorandum that sets out instructions is still always a good idea.</p>

<p>What something more complicated but more certain?</p>
<p>2) <strong>The Outright Gift Option</strong> &#8211; Consider a bequest to heirs or others who agree to care for one or more pets.  Remember, selection of such care takers is important where there is a flat and outright bequest sine there is no way of knowing how long the responsibility will last.  For that reason, and given the high cost of equestrian care, many horse and other pet owners prefer a gift to a trust where the trustee can ensure that care givers get what they need to Providence continuing care at the right level anticipated by your trust and in your memorandum of instructions.</p>
<p>3) <strong>The Trust Option</strong> &#8211; First, be aware that not all states permit a trust for pets and animals. Pennsylvania and thirty one other states have, however, adopted such a law.  Next, review the issues such as: identifying your pets (the ASPCA site even suggests DNA identification), identifying a caretaker and trustee.  A memorandum to the trustee and care takers with specifics about your pets needs, and your desires for care can be vital. Finally, determine how much will be needed and who gets the balance at the death of your pet or pets.</p>

			<content:encoded><![CDATA[<p>I know that the title to this article:  <strong>&#8220;Resources for Building and Protecting Your Estate and Your Estate Plan&#8221;</strong> is both long (imagine that, a long winded lawyer) and apparently silly.</p>
<p>How do I know that it sounded silly?</p>
<p>This is a suggestion for a resource sent to me by one of my sons when he read the draft of the title-</p>
<p>&#8220;Get a battle team then when hordes of marauding lawyers attempt to raid your party you can fight them with karate and such techniques.&#8221;</p>
<p>Well Josh, true enough.  But I really do have some great resources for the readers that don&#8217;t maintain &#8220;battle teams.&#8221;  but who want to avoid financial fraud and marauding hoards of lawyers.</p>
<p>I have always maintained, that an estate plan that focuses only on what happens to your assets when you die is, while important, a boring estate plan and one not likely to be of much help to you and your family <strong>while you&#8217;re alive.  </strong></p>

But Don&#8217;t Worry.<br />
<strong>The State Of Pennsylvania Has Done One For You.</strong><br />
How Do You Think That Will Work?</p>
<p>If you have a will and it&#8217;s more than a few years old, you may have to have it reviewed because of the volatile situation with the estate tax.  However, if you have never done a will it may be time. <p>The failure to have a properly executed and legal will at the time of death makes you INTESTATE under Pennsylvania law.  And, if you die intestate, the state automatically answers the following questions:</p>
<p><strong>1) Who gets your estate &#8211; it may not be who you think.</p>
<p>2) When kids get the assets.  Answer: 18.  That doesn&#8217;t sound good does it?</p>
<p>3) Who takes care of the kids &#8211; a court appointed guardian chosen by the judge (think legal fees too); and</p>
<p>4) Who manages the kids money &#8211; again, a court appointed guardian but only until age 18;</p>
<p>5) Who gets to be the administrator (the executor under a will) &#8211; and there are classes of people who may not be qualified and who might fight about who gets to do it (again, think legal fees and administrator fees).</strong></p>
<p>If you&#8217;d rather be in control of these and many other issues, thn completing and executing a valid will and/or will and trust is essential.</p>
<p>That process can be easy and inexpensive when compared to the high costs that often result from intestacy.</p>

			<content:encoded><![CDATA[<p><strong>Federal Estate Tax Reform and Certainty Is Needed</strong><br />

<p>Congress failed, at the end of the year to enact any estate tax reform. As a result, the tax was eliminated for a one year period.  This might seem like a blessing, but currently, many people&#8217;s documents no longer function as they were intended to work.  To add insult to injury, in just a few more months it is scheduled to return with a vengeance.  </p>
<p>On January 1, 2011, absent congressional action, the tax will return and American tax payers will only be able to shelter one million dollars.  A couple could, with careful planning, shelter up to two million dollars but that would require the use of trusts prepared during the lifetime of each spouse. And, as if that is not bad enough, the tax rate is going up to a maximum rate of 55%.</p>
<p>However, since this tax includes retirement accounts, the value of a house and business, and life insurance proceeds, the one million dollars may not go as far as it might otherwise.</p>
<p>We need and deserve clarity on this issue.</p>
<p>Yet, just a few weeks ago, negotiations between Republicans and Democrats broke down and Estate Tax reform disappeared from the legislative agenda.</p>
<p>This is not a political or partisan column.  And, for my money, both parties have failed to deal effectively with this issue. I simply believe that Congress owes certainty and clarity to the American people.  Right now, careful and rational estate and tax planning for families with substantial assets is almost impossible.</p>
<p>Clarity is essential and now requires congressional action.</p>

Married couples often believe that signing a joint signature card at the bank makes those assets impervious to creditor claims in the event you are sued.  And, while Pennsylvania law does offer some protection on joint accounts, you need to be careful and consider not only careful planning, but what you do after the account is opened.</p>
<p>For example, if a husband and wife own a joint account, and one of them gets sued, it is generally true that the creditors&#8217; cannot get the joint asset.  <a href="http://www.paestateplanners.com/blog/asset-protection-of-bank-accounts-its-not-all-about-the-signature-card.cfm">However, see this recent bankruptcy case that seems to say it is not just the signature card that matters but also what you do after the account is opened.<br />
