If you are a parent navigating custody issues in Pennsylvania, there’s an important change you should know about. Starting August 29, 2025, the rules courts use to decide custody will shift.
Under the current law, judges look at 16 different custody factors when deciding what arrangement is in a child’s best interest. But with the passage of House Bill 378, that list is being streamlined down to 12 factors.
So, what does that mean for you?
- Less confusing, less overwhelming: Many overlapping factors are being combined to make the process clearer.
- Still child-focused: The main concern for judges will always be your child’s safety, stability, and well-being.
Even if you plan to work out an agreement with the other parent, understanding what judges look for can help you negotiate from a stronger position.
At the end of the day, custody cases are about more than legal arguments, they’re about protecting your relationship with your child.
