Every lawyer in the Firm participates in, and contributes to, some aspect of the Firm's real estate practice. Unruh, Turner, Burke & Frees has developed a substantial, comprehensive and well respected real estate practice, and our clients include some of the largest and most respected commercial and residential developers in the region. Attorneys in the Firm represent individuals, real estate developers, builders, landlords and tenants in all facets of the sale, purchase, development, ownership, financing, rental and management of residential, commercial and retail real estate projects, including:
- Negotiating and preparing agreements for the sale and purchase of real estate, and advising sellers and purchasers in all facets of buying or selling real estate
- Representing lenders and borrowers in negotiating, structuring and closing on real estate acquisition, construction and permanent mortgage loans
- Negotiating and preparing leases for commercial, retail and residential properties
- Advising clients on the creation of, and preparing documents for, limited partnerships, joint ventures and other business organizations for the development, ownership leasing and management of real estate
- Negotiating and drafting construction contracts
- Counseling clients in the creation of condominiums, planned communities and other common ownership regimes for residential and commercial developments
- Preparing easements, rights-of-way and related documents
- Representing litigants in disputes arising out of leases, construction contracts agreements of sale and other real estate transactions
- Representing condemnees in challenging condemnations and recovering damages for property taken by eminent domain
- Bringing and defending adverse possession claims
- Representing and counseling homeowners' associations and similar organizations
- Representing land owners in tax assessment appeals
- Representing real estate agents and real estate brokerage firms generally, as well as in litigation and disciplinary proceedings
- Representing property owners and real estate brokers in claims alleging violation of anti-discrimination and fair housing laws
- Reviewing and negotiating title insurance coverages on behalf of owners, purchasers, lessees, and lenders
