Unruh Turner Burke & Frees recently secured a victory on summary judgment for its client in a real estate boundary dispute case in the Chester County Court of Common Pleas. Our attorney represented the client over the course of months of contentious litigation, which involved filing and defending against numerous discovery and pretrial motions.
The plaintiff in the case alleged a single trespass claim against various defendants, including one of the firm’s clients. The narrow legal issue to be decided involved whether a survey incorrectly set out the metes and bounds. Plaintiff, however, failed to obtain their own survey to prove their cause of action, in solely relying upon the chain of title in an attempt to prove the case.
The court rejected the plaintiff’s contentions and, in adopting the firm’s arguments, held that the plaintiff’s failure to obtain a survey as well as provide a qualified expert’s report warranted entry of summary judgment against plaintiff and in favor of the firm’s client.
